This constitution is not a proof for Muslim nationalism but rather a tool towards Islamic unification of all Muslim countries. This is the modern version of constitution of Medina.
Article 1 Country Name, Capital and Language The (country name) is a sovereign (ethnicity) Islamic republic with Islam as its religion, God's Book and the Sunnah of His prophet (PBUH) are its basis of constitution, (language) is its language and (capital) is its capital.
Article 2 What is the Islamic Republic
The Islamic republic is a system based on belief in One God, His exclusive sovereignty and right to legislate, and the necessity of Divine Revelation and its fundamental role in setting forth the laws.
Article 3 The Basis of Government
In the Islamic republic the entire edifice of government is based on the protection of Islam and justice, its implementation, and the welfare of the Muslims and the non-Muslims both citizens and foreign residents.
Article 4 Nature of Public Institutions
All institutions of government will be made on the basis of Islamic progress, the need of the people, the survival of the land, its resources, its boundaries, its air and its sea and rivers.
Article 5 Creators of Organisations and Institutions in the Republic
The Guardian council along with the help of other scientific, security and technological experts will form the outline of the government institutions and the nature private institutions and organizations will work in the country. Extension: Ministries are set up according to the Guardian council dictates in collaboration with the parliament.
Article 6 Formation of New ideas and Solutions
The Guardian council will select a body to analyze the texts of the Holy Quran and Hadeeth to form new ideas, policies and methods of government and justice.
Article 7 The Purpose of The Government
The Government must direct its effort to ensure:
•Creation of a favorable environment for the growth of moral virtues based on faith and piety and the struggle against all forms of vice and corruption. •Raising the level of public awareness in all areas through the proper use of the press, mass media and other innovative means. •Free education and physical training for everyone at all levels, and the facilitation and expansion of higher education and research. •Strengthening the spirit of inquiry, investigation and innovation in all areas of science, technology and culture as well as Islamic studies through research centers. •Elimination of Imperialism and prevention of foreign influence •Ensuring freedom within the framework of Islamic Law •Abolition of discrimination based on Islamic law, and the provision of equitable opportunities in both economic and intellectual spheres for all citizens. •Strengthening of defense by building up the defense system and personnel by patriotic people. •Planning of a just and correct economic system in accordance with Islam, making welfare, eliminate poverty and abolish all forms of deprivation with respect to food, housing, healthcare and the provision of social insurance for all. •Ensuring the safeguard of people's rights based on Islamic law •Eradicating racism and aristocracy among the people and their conscience through efficient education and social programs
Article 8 The Republic’s Flag
The republic's flag shall be (only for geographical identification and not nationalism):
Anything except the depiction of living beings or which depict moral vices.
Article 9 The Nature of Law and Legal System
All aspects of the law must be based on Islam in regards to Muslims and in regards to state security, international relation, trade and foreign policy. Non-Muslims can choose to consider the Islamic legal system or their religious legal system in the following domains:
•Family •Criminal (only when it relates to individual crimes against each other i.e. non-Muslim to non-Muslim)
Extension: The Guardian council will define the Holy Law and will give the charge to the judiciary a selected body of competent jurists. The executive will obey the judiciary in the case of implementation of Law. Any disputes in the government system or branches where there is no resolving law/rules/protocols will be presented to the relevant court.
Extension: Laws are meant to be followed and adhered to. So the laws must be informed to the public through proper channels. If a law was made unware then a citizen will not be held accountable for breaching this law.
Article 10 The Sovereign head of Republic
The absolute power lies with the Imam (Supreme Leader) Guardian council who are the holders of Divine knowledge. The supreme leader i.e. the Imam is elected by the members of the Guardian council. The president will be elected by the people after nominated by 2/3 vote of the Guardian council.
The Imam is the supreme head of all the republic and the government institutions. The Imam has no power to dismiss any member of the Guardian council without the majority vote of the Guardian council. If the Imam errs and fails to fulfill his duty he will be removed by 2/3 majority of the Guardian council.
The Guardian council members are elected by the people through the system of meritocracy and religiosity.
Article 11 The Duty of The Military, Security forces and Government
Defense, security forces and public institutions are to pay allegiance to the Imam on the basis of Holy Quran and Sunnah in submission and obedience, in times of ease and hardship, fortune and adversary.
Article 12 The Elected Administration
In accordance with the command of the Holy Quran (43:38), consultative bodies-such as Islamic consultative, the Islamic consultative assembly, the provincial councils, city, regions, district and village councils and the likes of them are the decision-making and administrative organs of the country where the members of parliament are elected through region based election. The nature of such councils throughout the country, their duties, scope and jurisdiction, functions determined by this constitution, Guardian council, parliament and laws in that order.
Article 14 The Muslim Family
The Muslim family is the kernel of the Islamic society and its members shall be brought up on the basis of the Islamic faith and loyalty and obedience to God, His prophet, Imams of Islam and to the Imam and the Guardians of the Islamic Republic
Article 15 The Basis of National Security
Respect for and implementation of the law, love and pride in the Islamic republic must be one of the main ideological and moral education for citizens and permanent residence.
Article 16 The Rights of Individual and Group
No individual or group or authority has the right to infringe in the slightest way upon the political, cultural, economic and military independence or the territorial integrity of the Islamic republic under the pretext of exercising freedom. Article 17 The Need for Islamic Dialogue
Quran (21:92) demands that the government of the Islamic republic takes steps to work for the betterment and unification of the Muslims worldwide starting from in their republic through dialogue, education, and scholarly meetings and speeches to the masses.
Article 18 The Moral Purpose of Islamic Republic
Islamic Republic is based on principle of preventing evils and the means leading to it, thus the legal principle of "Sad Zaria" is carefully implemented by the government in a balanced and measured way.
Article 19 The National Fatwa Council
There shall be a national fatwa-council whose fatwa is the ONLY recognized fatwa for the Muslims in their worship and religious issues.
Article 20 The Rights of Non-Muslims
Quran (60:8) directs us to treat non-Muslims with kindness thus the Islamic republic has to respect the rights of all non-Muslims both citizen and foreign within the boundaries of Islamic Law, fairness and common sense.
Article 21 The Rights of Minorities
All religious minorities are free to perform their religious rites and ceremonies and to act according to their own canon in matters of personal affairs and religious education provided it does not breach or threaten the security and stability of the Islamic republic.
Article 22 The Natural Resource
The citizens must receive a portion of wealth from the revenues of the natural resources of the republic.
Article 23 The Protection of Privacy
Privacy of the citizens is respected except under three circumstances:
•Citizen/citizens willingly allowed interference in his/her/their privacy •A citizen of interest directly related to a crime. •A suspect or a group of suspects, based on prima facie, involved in a crime which threatens physically and ideologically the Islamic republic, society and the security of the individual people.
Privacy intervention must under these must be temporary.
Article 24 The Financial And Economic Paradigm
The law must lay down the norms of dealings with the three entities: public, private and international.
Finance and economy:
All the republic's revenues and expenditures will come under monitoring bodies (appropriate ministries and institutions under such ministries) and such ministries will control all the republic’s movable and immovable funds/goods/resources in order to confirm the good use of these funds and their preservation. An annual report will be submitted on this matter to the head of the Council of Scholars. The council of scholars selected by the parliament will define the competent control body and its obligations and prerogatives.
An independent caretaking body will be appointed by the Guardian council in collaboration with academics to monitor and look after all the government institutions. This body will investigate offenses of the government and private institutions and an annual report will be submitted on this matter to the Guardian council. The Guardian council will make such a caretaking body who will consist of workers of needed expertise and knowledge suitable and able to understand the running and method of the institutions both government and private in the country.
Republic's revenue and its entry in the republic's general budget should be seen and monitored by the selected body of economists and accountants. Revenue is entered and spent in accordance with the aims and objectives of the constitution.
The Guardian council will take emergency measures to deal with immediate threats and obstacles whether administrative, military, social or international levels. For this a special fund is made.
The annual budget will be spent among two categories:
•Public institutions •Private institutions involved in scientific research and social development The law ministry along with ministry of finance will define the details of these categories. Any new additional field needed will be opened and a new budget will be made. The budget will be announced at the start of the Islamic calendar each year.
If any institution (private/public/international) has deceived the government from giving its proper due to the republic then it shall be looked in to either by republic intelligence or by the court depending on the delicacy of the matter.
All financial reports must be published with details and a summary to the relevant ministries.
The system of economy will be controlled free market.
Tax is implemented.
Imposition, amendment, revocation and exemption is only permitted by the law
Zakat is collected and distributed by the proper ministry to the proper recipients as stated in Quran. All individual Muslims must pay Zakat to the government.
Article 25 Amending The Constitution
All writings are changeable except the book of God thus constitution is amended by the majority vote of the Guardian council including the Imam
